Suit filed for Girl in Bus-Train crash

The mother of a 16-year-old Cary-Grove High School student who was injured in the Oct. 25 bus-train accident in Fox River Grove has filed suit in McHenry County Circuit Court for an unspecified amount of damages.
Tara Bennett, a junior, of Fox River Grove, was hospitalized for three days at Good Shepherd Hospital with a fractured skull, but has since returned to class, said Robert Hanaford, the attorney for her mother, Patricia Schultz, who filed the personal injury suit.
Those accused of negligence include the Union Pacific Railroad, which owns the tracks and railroad signal devices, for allegedly failing to monitor the signals to allow enough time for vehicles to cross the grading; and the Regional Transportation Authority because its Metra train allegedly failed to sound its horn in time for the bus to get off the crossing.
Also accused of negligence were Contracting and Materials Co. for allegedly failing to maintain the signals after being given that responsibility by the Illinois Department of Transportation; Crystal Lake School District 155; and bus driver Patricia Catencamp.
